释义	自然人是自然规律出生的人，所以精神病人模带也是自然人，是民事法律关系的主体，但是它不具有民事行为能力和民事责任能力。法律依据：《中华人民共和国民法典》第十三条自然人从出生时起到死亡时止，具有民事权利能力，依法享有民事权利，承担民事义务。第二十一条不能辨认自己行为的成年人为无民事行为能力人，由其法旦者芦定代理人代理实施民事法律行为。八周岁以上的未成年人不能辨认自己行为的，适用前款规定。
