释义	法律分析: 诉讼时效期间届满，当事人可能丧失胜诉权，也就是说如果在诉讼中，对方提出已过诉讼时效的抗辩的，法院将判决驳回原告的诉讼请求。但如果对方没有提出诉讼时效抗辩的，原告的诉讼请求不会因超过诉讼时效而被法院驳回。法律依据: 《最高人民法院关于审理民事案件适用诉讼时效制度若干问题的规定》第三条当事人未提出诉讼时效抗辩，人民法院不应对诉讼时效问题进行释明及主动适用诉讼时效的规定进行裁判。
