释义	《刑法》第二十条第二款规定“正当防卫明显超过必要的限度造成重大损害的应付刑事责任。”实行防卫不能明显超过必要限度。超过这一限度，造成重大损害的，是防卫过当。防卫行为一旦过当，正当防卫也就不能成立。法律依据：《中华人民共和国民法通则》第一百二十八条正当防卫超过必要的限度，造成不应有的损害的，应当承担适当的民事责任。《中华人民共和国刑法》第二十条正当防卫明显超过必要的限度造成重大损害的应负刑事责任。
