法律分析:
第三者责任险是指被保险人及其财产和保险车辆上所有人员与财产以外的他人、他物。 所谓“所有人员”，车上的驾驶员、售票员、装卸工、乘客、搭客等，这些人不属于第三者，但下车后除驾驶员外，均可视为第三者。
法律依据:
中国保险监督管理委员会发布的《中国保险监督管理委员会关于印发〈机动车辆保险条款解释〉和〈机动车辆保险费率解释〉的通知》 二、第三者责任险：保险车辆因意外事故，致使他人遭受人身伤亡或财产的直接损失，保险人依照保险合同的规定给予赔偿。
