释义	法律分析：首先双方的婚姻关系必须还存在，若夫妻关情破裂已经离异的则扶养义务消亡，当事人不得控告对方。但若是在婚姻关系存续期间夫妻一方失去独立生活能力，另一方则需肩负起扶养的义务。如果另一方拒绝扶养的话，情节严重的话，则会构成遗弃罪。法律依据：《中华人民共和国刑法》第二百六十一条对于年老、年幼、患病或者其他没有独立生活能力的人，负有扶养义务而拒绝扶养，情节恶劣的，处五年以下有期徒刑、拘役或者管制。
