释义	法律分析：有遗弃行为可以认定。只要被遗弃一方属于年老、年幼、患病或者其他没有独立生活能力的人就可以，也即是说被遗弃一方属于前款规定的人即可，如果客观情形确实如此，不需要鉴定，对于精神疾病的问题，如果双方对是否存在精神疾病有争议，可能需要鉴定。如果并未造成严重后果，则不构成遗弃罪。法律依据：《中华人民共和国刑法》第二百六十一条对于年老、年幼、患病或者其他没有独立生活能力的人，负有扶养义务而拒绝扶养，情节恶劣的，处五年以下有期徒刑、拘役或者管制。
