释义	法律分析：在承揽合同中，发生人身损害由承揽人承担责任为一般原则，定作人承担相应责任为例外。定作人是否承担赔偿责任在于其是否具有定作、指示或者选任中的过失。承揽关系中定作人选任无过失，不应承担民事责任法律依据：《最高人民法院关于审理人身损害赔偿案件适用法律若干问题的解释》第十条承揽人在完成工作的过程中对第三人造成损害或者自身损害的，定作人不承担赔偿责任。但定作人对定作、指示或者选任有过失的，应当承担相应的赔偿责任。
