释义	法律主观：累犯前后两罪并非一样，但是都必须是故意犯罪，并且系成年人犯罪。所谓累犯，是指受过一定的刑罚处罚，刑罚执行完毕或者赦免以后，在法定期限内又犯被判处一定的刑罚之罪的罪犯。累犯分为一般累犯和特殊累犯两种。 1、一般累犯：是指被判处有期徒刑以上刑罚的犯罪分子，刑罚执行完毕或者赦免以后，在5年以内再犯应当判处有期徒刑以上刑罚之罪的犯罪分子。 2、特殊累犯：是指因犯特定之罪而受过刑罚处罚，在刑罚执行完毕或者赦免以后，又犯该特定之罪的犯罪分子。
