我国的土地归国家和集体所有：
1、土地所有权是国家或农民集体依法对归其所有的土地所享有的具有支配性和绝对性的权利。
2、农村和城市郊区的土地，除由法律规定属于国家所有的以外，属于农民集体所有；宅基地和自留地、自留山，属于农民集体所有。
