刑法中关于丢失枪支是怎样量刑
释义
现行刑法对丢失枪支不报罪的量刑规定为，依法配备公务用枪的人员，丢失枪支不及时报告，造成严重后果的，处三年以下有期徒刑或者拘役。该罪主要是不作为犯罪，指行为人在丢失枪支后应当及时报告而没有报告的情形。
【法律依据】
《中华人民共和国刑法》第十四条
明知自己的行为会发生危害社会的结果，并且希望或者放任这种结果发生，因而构成犯罪的，是故意犯罪。
故意犯罪，应当负刑事责任。
第一百二十九条
依法配备公务用枪的人员，丢失枪支不及时报告，造成严重后果的，处三年以下有期徒刑或者拘役。
