释义	不火化下葬违不犯法的。国家实行火葬制度。除少数民族因风俗习惯不适宜推行火葬的之外，都应当实行火葬。农村居民去世后，不火化遗体，实施土葬是犯法行为。但是，在实不具备条件实行火葬的地区实行土葬不是犯法行为。法律依据《殡葬管理条例》第四条，人口稠密、耕地较少、交通方便的地区，应当实行火葬；暂不具备条件实行火葬的地区，允许土葬。实行火葬和允许土葬的地区，由省、自治区、直辖市人民政府划定，并由本级人民政府民政部门报民政部门备案。
