释义	法律分析：当天不会拘留，醉酒驾驶会被判刑的。但是一般不会拘留，等一个星期，酒精检验结果出来，达到醉驾标准，会办理取保候审，之后再等法院判刑。法律依据：《公安机关办理醉酒驾驶刑事案件程序规定（试行）》第二十九条抽取的血样应当在一日内送县级以上公安机关刑事技术部门或者其他具备资格的检验鉴定机构进行检验鉴定。上述机构应当及时指派、聘请具有鉴定资格的人员进行检验鉴定。因特殊原因不能在规定时限内将抽取血样送检的，报经公安机关交通管理部门负责人批准，送检时限可以延长至三日。
