释义	法律分析：单纯的高利贷只是违法行为，并不构成犯罪。一般而言，高利贷是指索取特别高额利息的贷款行为。认定高利贷要注意下面，原则上说民间借贷利息不能超过银行同期利率的4倍，超过了就是高利贷，法律不予保护。法律依据：《中华人民共和国刑法》第一百七十五条高利转贷罪，即以转贷牟利为目的，套取金融机构信贷资金高利转贷他人，违法所得数额较大的，处三年以下有期徒刑或者拘役，并处违法所得一倍以上五倍以下罚金额巨大的，处三年以上七年以下有期徒刑，并处违法所得一倍以上五倍以下罚金。
