释义	法律分析：发生交通事故后才喝酒的,不能算酒驾或醉驾。事故后才喝酒的,证人证言也可以作为证据使用,但证明力较弱,也不能只采信一面之词,应该有多人证明才可信。是否酒驾主要以事故现场吹气或检血的结果为准,其他证据只能作为佐证。法律依据：《中华人民共和国道路交通安全法》第九十一条饮酒后驾驶机动车的，处暂扣6个月机动车驾驶证，并处1000元以上2000元以下罚款。因饮酒后驾驶机动车被处罚，再次饮酒后驾驶机动车的，处10日以下拘留，并处1000元以上2000元以下罚款，吊销机动车驾驶证。
