释义	孕妇，哺乳期妇女均属于特殊法律主体，涉嫌刑事犯罪时，由于身份特殊，刑法对其给予了特殊保护。根据我国相关法律规定，对符合逮捕条件，但有特殊情形的犯罪嫌疑人、被告人，可以监视居住，其中就包括怀孕或者正在哺乳自己婴儿的妇女。除此之外，刑事诉讼法还对孕妇犯罪的其他情形也作了保护规定。刑事诉讼法还规定，在执行死刑的过程中，发现罪犯正在怀孕的，应当停止执行，并且立即报告最高人民法院，由最高人民法院作出裁定；裁定停止执行的，应当报请最高人民法院依法改判。
