法律主观：
我国《 商标法 》第60条第2款明确规定：“销售不知道是侵犯 注册商标 专用权的商品，能证明该商品是自己合法取得并说明提供者的，由工商行政管理部门责令停止销售。”由此可见，即使是在不知情的情况下销售了侵犯注册商标专用权的商品的，也构成侵犯注册商标专用权。法律同时规定了，如果侵权人不知情，并且能证明该商品是自己合法取得并说明提供者的，由工商行政管理部门责令停止销售。不知情的侵权人也需要承担停止销售该产品，提供购买渠道以协助查办伪劣产品来源等 侵权责任 。
