释义	法律主观：不属于固定资产。股权投资不属于固定资产，公司股权，银行存款、股票、基金等都属于金融资产。固定资产要有两个条件： 1、为生产商品提供劳务经营管理而持有的有形资产， 2、寿命是超过一个会计年度。《公司法》第三十四条，股东按照实缴的出资比例分取红利；公司新增资本时，股东有权优先按照实缴的出资比例认缴出资。但是，全体股东约定不按照出资比例分取红利或者不按照出资比例优先认缴出资的除外。
