释义	法律分析：诉由并不是指诉讼理由,诉由规范称谓是“案由”，民事诉讼的案由，是对民事诉讼内容中所涉及的法律关系的缩影，是法院对一个具体案件进行分类和定性的依据。诉讼理由是指提起诉讼和进行诉讼的理由。客观存在而又可以证明的事实，才能成为诉讼的理由。法律依据：《最高人民法院关于印发＜民事案件案由规定（试行）＞的通知》第一条第一审法院立案时可根据当事人的起诉确定案由。当事人起诉的法律关系与实际诉争的法律关系不符时，结案时以法庭查明的当事人之间实际存在的法律关系作为确定案由的依据。
