法律分析：
制假售假在刑法上的罪名是销售假冒伪劣商品罪。
法律依据：
《最高人民检察院公安部关于公安机关管辖的刑事案件立案追诉标准的规定(一)》 第十六条 生产者、销售者在产品中掺杂、掺假，以假充真，以次充好或者以不合格产品冒充合格产品，涉嫌下列情形之一的，应予立案追诉：
1、伪劣产品销售金额五万元以上的;
2、伪劣产品尚未销售，货值金额十五万元以上的;
3、伪劣产品销售金额不满五万元，但将已销售金额乘以三倍后，与尚未销售的伪劣产品货值金额合计十五万元以上的。
