法律依据：《中华人民共和国烟草专卖法》 第二十八条 违反本法规定擅自收购烟叶的，由烟草专卖行政主管部门处以罚款，并按照查获地省级烟草专卖行政主管部门出具的上年度烟叶平均收购价格的百分之七十收购违法收购的烟叶；数量巨大的，没收违法收购的烟叶和违法所得。
