民事诉讼流程如下：
1、原告起诉；
2、法院受理后将起诉书副本送达被告；
3、被告在十五日内提交答辩状，法院在五日内将答辩状副本送达原告如果被告不提交答辩状，不影响审理；
4、决定开庭审理的案件，法院在三日前通知当事人并公告。
人民法院审理下列民事案件，不得由审判员一人独任审理：
1、涉及国家利益、社会公共利益的案件；
2、涉及群体性纠纷，可能影响社会稳定的案件；
3、人民群众广泛关注或者其他社会影响较大的案件；
4、属于新类型或者疑难复杂的案件；
5、法律规定应当组成合议庭审理的案件；
6、其他不宜由审判员一人独任审理的案件。

民族自治地方的人民代表大会根据宪法和本法的原则，结合当地民族的具体情况，可以制定变通或者补充的规定。自治区的规定，报全国人民代表大会常务委员会批准。自治州、自治县的规定，报省或者自治区的人民代表大会常务委员会批准，并报全国人民代表大会常务委员会备案。
