释义	法律分析：私开补习班是违法的。教育局明确规定，在职教师不能在假期私自对学生补课，也就是说不能暑假办补习班。法律依据：《中华人民共和国教育法》第七十五条根据以往情况，凡在职教师利用寒暑假办班的，都没有而且也得不到教育局批准，因为教师有休息权、参加培训权，教师这些权利在假期里要得到维护。因此，在职教师利用假期办班，基本上属于非法办学，应该严格禁止。已经办的，要予以取缔。
