释义	法律分析： “斡旋”顾名思义会有三方，直接利用职务的国家工作人员与行贿人，以及这个作为中间人的国家工作人员。斡旋受贿，主体也必须是国家工作人员，而且不是直接通过自己的职务行为，而是利用职务或者地位上的便利疏通其他国家工作人员，是通过其他国家工作人员的职务行为帮请托人实现不正当的利益。法律依据：《中华人民共和国刑法》第三百八十八条国家工作人员利用本人职权或者地位形成的便利条件，通过其他国家工作人员职务上的行为，为请托人谋取不正当利益，索取请托人财物或者收受请托人财物的，以受贿论处。
