释义	法律分析：父母有抚养未成年子女的义务,不履行抚养义务,是属于违反婚姻法的违法行为。母亲是否要抚养孩子要看具体情况，如果是夫妻双方存续期间内，那么母亲必须抚养孩子，否则就是违法；如果是已经离婚的，按照双方约定或者法院判决确定，约定或者判决由父亲来抚养的，则母亲不必抚养孩子，但要给予抚养费用。也就是说这种情况下，母亲不抚养孩子不违法。法律依据：《中华人民共和国民法典》第一千零五十八条夫妻双方平等享有对未成年子女抚养、教育和保护的权利，共同承担对未成年子女抚养、教育和保护的义务。
