释义	股权赠与合同不公正有效，公证并非法定的赠与合同生效条件，赠与关系的成立以赠与物交付为准。但赠与人和受赠人双方协商一致进行公证，是意思自治行为，法律也不禁止。【法律依据】《中华人民共和国民法典》第六百五十八条赠与人在赠与财产的权利转移之前可以撤销赠与。经过公证的赠与合同或者依法不得撤销的具有救灾、扶贫、助残等公益、道德义务性质的赠与合同，不适用前款规定。第六百五十九条赠与的财产依法需要办理登记或者其他手续的，应当办理有关手续。
