释义	法律分析： 1979年7月1日,全国人民大会第二次会议通过了新中国第一部刑法典。法律依据：《中华人民共和国刑法》第四百五十二条本法自1997年10月1日起施行。列于本法附件一的全国人民代表大会常务委员会制定的条例、补充规定和决定，已纳入本法或者已不适用，自本法施行之日起，予以废止。列于本法附件二的全国人民代表大会常务委员会制定的补充规定和决定予以保留。其中，有关行政处罚和行政措施的规定继续有效;有关刑事责任的规定已纳入本法，自本法施行之日起，适用本法规定。
