释义	依据我国刑事诉讼法司法解释的规定，刑事案件不同的证据查证的方式是不一样的，法院会对证据进行查实，审实后才能作为证据使用。法律依据：《最高人民法院关于适用的解释》第六十一条认定案件事实，必须以证据为根据。第六十二条审判人员应当依照法定程序收集、审查、核实、认定证据。第六十三条证据未经当庭出示、辨认、质证等法庭调查程序查证属实，不得作为定案的根据，但法律和本解释另有规定的除外。
