法律分析:
挪用班费一般不构成犯罪。不符合有关罪名的主体要求。挪用资金罪或者挪用公款罪的主体为特殊主体，即公司、企业或者其他单位的工作人员。具体包括三种不同身份的自然人，一是股份有限公司、有限责任公司的董事、监事，二是上述公司的工作人员，是指除公司董事、监事之外的经理、部门负责人和其他一般职工。上述的董事、监事和职工必须不具有国家工作人员身份。三是上述企业以外的企业或者其他单位的职工，包括集体性质的企业、私营企业、外商独资企业的职工，另外在国有公司、国有企业、中外合资、中外合作股份制公司、企业中不具有国家工作人员身份的所有其他职工以及受国家机关、国有公司、企业、事业单位、人民团体委托，管理、经营国有财产的非国家工作人员。
法律依据:
《中华人民共和国刑法》 第二百七十二条 公司、企业或者其他单位的工作人员，利用职务上的便利，挪用本单位资金归个人使用或者借贷给他人，数额较大、超过三个月未还的，或者虽未超过三个月，但数额较大、进行营利活动的，或者进行非法活动的，处三年以下有期徒刑或者拘役;挪用本单位资金数额巨大的，或者数额较大不退还的，处三年以上十年以下有期徒刑。
