释义	法律分析：旅游者因病不能出游的，可以要求旅行社退还团费。法律依据：《关于审理旅游纠纷案件适用法律若干问题的规定》第十二条旅游行程开始前或者进行中，因旅游者单方解除合同，旅游者请求旅游经营者退还尚未实际发生的费用，或者旅游经营者请求旅游者支付合理费用的，人民法院应予支持。如果是旅游行程结束前，旅游者解除合同，旅游社扣除必要费用后返还余款。《中华人民共和国旅游法》第六十五条旅游行程结束前，旅游者解除合同的，组团社应当在扣除必要的费用后，将余款退还旅游者。
