释义	法律分析：员工离职不可以拿回劳动合同。员工辞职后，劳动关系解除，双方的权利与义务已经履行完毕，劳动合同对双方已无约束力。按照法律规定，用人单位对已经解除或者终止的劳动合同的文本，至少保存二年备查。法律依据：《中华人民共和国劳动合同法》第十六条劳动合同由用人单位与劳动者协商一致，并经用人单位与劳动者在劳动合同文本上签字或者盖章生效。劳动合同文本由用人单位和劳动者各执一份。
