工伤伤残鉴定有时间限制吗
释义
实践中，一般要均要求在收到工伤认定决定书三个月后才能申请劳动能力鉴定，这种做法没有法律依据。按《工伤保险条例》的规定，职工发生工伤，经治疗伤情相对稳定后存在残疾、影响劳动能力的，或者停工留薪期满（含劳动能力鉴定委员会确认的延长期限），工伤职工或者其用人单位应当及时向设区的市级劳动能力鉴定委员会提出劳动能力鉴定申请。故进行劳动能力鉴定需等到伤情稳定后，在此法律没有给出具体期限，伤情稳定后及时申请劳动能力鉴定有利于进行赔付。
