释义	法律分析：扰乱法庭秩序罪属于行为犯，只要实施了刑法规定的下列行为之一并达到一定严重程度，就可以定罪量刑，处三年以下有期徒刑、拘役、管制或罚金法律依据：《中华人民共和国民事诉讼法》第一百零一条人民法院对违反法庭规则的人，可以予以训诫，责令退出法庭或者予以罚款、拘留。人民法院对哄闹、冲击法庭、污辱、诽谤、威胁、殴打审判人员，严重扰乱法庭秩序的人，依法追究刑事责任；情节较轻的，予以罚款、拘留。
