释义	质押和质权不是一个意思。质权在质押合同生效后成立。质押是指债务人或第三人将其动产或者权利移交债权人占有的行为，将该动产作为支付金钱或履行责任的担保，债务人如果没有履行债务时，债权人就有权依法就该动产卖得价金优先受偿。【法律依据】《民法典》第四百二十五条为担保债务的履行，债务人或者第三人将其动产出质给债权人占有的，债务人不履行到期债务或者发生当事人约定的实现质权的情形，债权人有权就该动产优先受偿。前款规定的债务人或者第三人为出质人，债权人为质权人，交付的动产为质押财产。
