释义	法律分析：如果法律规定某一行为应当在三年以上十年以下量刑，那么顶格判决的意见就是判十年。法律依据：《中华人民共和国刑法》第三十三条主刑的种类如下：（一）管制；（二）拘役；（三）有期徒刑；（四）无期徒刑；（五）死刑。第四十六条被判处有期徒刑、无期徒刑的犯罪分子，在监狱或者其他执行场所执行；凡有劳动能力的，都应当参加劳动，接受教育和改造。第四十八条死刑只适用于罪行极其严重的犯罪分子。对于应当判处死刑的犯罪分子，如果不是必须立即执行的，可以判处死刑同时宣告缓期二年执行。
