释义	间谍罪是行为犯,并不以实际上发生法定的危害结果作为犯罪成立的要件,只要实施了间谍行为,即构成本罪。法律依据:《中华人民共和国刑法》第一百一十条有下列间谍行为之一，危害国家安全的，处十年以上有期徒刑或者无期徒刑；情节较轻的，处三年以上十年以下有期徒刑：（一）参加间谍组织或者接受间谍组织及其代理人的任务的；（二）为敌人指示轰击目标的。
