问题	民法典中离婚协议能否诉讼变更
释义	一般是不可以的。离婚协议生效后一般不予变更，但是就财产分割问题反悔，若发现订立财产分割协议时存在欺诈、胁迫等情形的，可以撤销财产分割协议。如果是对于抚养权分割问题反悔的，可以申请诉讼变更抚养权。法律依据《最高人民法院关于适用〈中华人民共和国民法典〉婚姻家庭编的解释（一）》第七十条夫妻双方协议离婚后就财产分割问题反悔，请求撤销财产分割协议的，人民法院应当受理。人民法院审理后，未发现订立财产分割协议时存在欺诈、胁迫等情形的，应当依法驳回当事人的诉讼请求。
