释义	法律分析：是。认定商标侵权并非说是假货，在同类或相似产品上使用他人合法商标就构成商标侵权。法律依据：《中华人民共和国商标法》第三十八条有下列行为之一的，均属侵犯注册商标专用权：(1)未经注册商标所有人的许可，在同一种商品或者类似商品上使用与其注册商标相同或者近似的商标的;(2)销售明知是假冒注册商标的商品的;(3)伪造擅自制造他人注册商标标识或者销售伪造、擅自制造的注册商标标识的;(4)给他人的注册商标专用权造成其他损害的。
