释义	担保人没签合同的，一般不算借款人。借款人是向贷款人借款，并到期还本付息的人，而担保人可以是借款人，也可以是为借款人提供的担保人。合同未签字的，则合同一般还未生效，合同关系还未成立。法律依据：《民法典》第四百九十条当事人采用合同书形式订立合同的，自当事人均签名、盖章或者按指印时合同成立。在签名、盖章或者按指印之前，当事人一方已经履行主要义务，对方接受时，该合同成立。《民法典》第六百六十七条借款合同是借款人向贷款人借款，到期返还借款并支付利息的合同。
