如果死者还有财产，就需要用留下来的财产进行偿还。继承财产的继承人，需要继续清偿死者的债务。如果死者没有财产的，就不要求返还。根据有关法律法规，继承遗产应该要清偿被继承人依据法律的规定，应该要缴纳的一定税款和债务，以遗产的实际价值为限缴纳一定的税款和债务。
债务人死亡之后，就对应的债务并不会消失，而且会由于死亡债务人的责任的继承关系转移到对应的责任人的身上。由责任人承担相关债务，即责任人成为新的债务人，与债权人继续构成原债务关系。人死后欠下的债由继承遗产的继承人在继承遗产范围内承担。继承人在遗产部分内承担清偿义务，超出债务人遗产的部分，原则上不再由其继承人承担。
债务人死亡，债务不能消灭。
债权人要追讨债务，首先看债务人是否留有财产，其次看有无债务担保人。一般公民死亡后，有财产的，他的债务由他的继承人承担；无财产的或者继承人放弃继承的，继承人不承担被继承人的债务。
法律依据：《继承法》第三十三条规定：“继承遗产应当清偿被继承人依法应当缴纳的税款和债务，缴纳税款和清偿债务以他的遗产实际价值为限。超过遗产实际价值部分，继承人自愿偿还的不在此限。继承人放弃继承的，对被继承人依法应当缴纳的税款和债务可以不负偿还责任。
