释义	不能。人民法院审理民事案件，应当根据自愿和合法的原则进行调解，调解笔录的内容不能作为判决的依据。当事人为达成调解协议或者和解协议作出妥协和让步而认可的事实，不得在后续的诉讼中作为对其不利的根据，但是法律另有规定或者当事人均同意的除外。
