刑法减轻处罚
释义
法律分析：减轻处罚是指在法定刑以下适用刑罚，只限于主刑。有一般减轻与特别减轻之分，前者适用于一切犯罪，后者由刑法特别规定并只适用于特定犯罪。中国刑法没有特别减轻的规定。对于不具有法定减轻情节的犯罪分子，人民法院可以根据具体情况酌定对其减轻处罚。
法律依据：《中华人民共和国刑法》 第二十二条 为了犯罪，准备工具、制造条件的，是犯罪预备。 对于预备犯，可以比照既遂犯从轻、减轻处罚或者免除处罚。
