释义	法律分析：对于有作为义务的见死不救，那行为人是触犯刑法的。一般定性为故意杀人罪。法律依据：《中华人民共和国刑法》第二百三十二条故意杀人的，处死刑、无期徒刑或者十年以上有期徒刑；情节较轻的，处三年以上十年以下有期徒刑。故意杀人罪是行为犯，只要行为人实施了故意杀人的行为，就构成故意杀人罪。由于生命权利是公民人身权利中最基本、最重要的权利，因此，不管被害人是否实际被杀，不管杀人行为处于故意犯罪的预备、未遂、中止等哪个阶段，都构成犯罪，应当立案追究。
