释义	法律分析：合同的保证金，合同保证金指的是签订合同的一种约定。保证金具有担保的作用。具体来说，保证金的作用根据签约目的或者一方当事人的请求而有所不同。签约、成约、证约、履约、违约、解约等等都可以保证金为媒介起担保作用。法律依据：《中华人民共和国民法典》第一百一十五条当事人可以依照《中华人民共和国担保法》约定一方向对方给付定金作为债权的担保。债务人履行债务后，定金应当抵作价款或者收回。给付定金的一方不履行约定的债务的，无权要求返还定金受定金的一方不履行约定的债务的，应当双倍返还定金。
