释义	村委会是可以依法出租村集体所有土地的。如果是出租耕地，只可以向本村的村民出租，不可以向外村的人员出租。出租荒山、荒地等，就可以通过拍卖、招标等方式向任何人进行出租，但是需要提前通过本村村民会议，并且要报乡镇政府进行批准。另外，本村的村民还可以享有优先承包权利。根据《中华人民共和国农村土地承包法》第四十七条：承包方可以用承包地的土地经营权向金融机构融资担保，并向发包方备案。
