法律分析：空壳公司的法定代表人存在法律风险。很多犯罪团伙利用空壳公司进行违法犯罪活动，作为空壳公司的法定代表人如参与诈骗等违法活动，应依法承担刑事责任。
法律依据：《中华人民共和国刑法》 第三十一条 单位犯罪的，对单位判处罚金，并对其直接负责的主管人员和其他直接责任人员判处刑罚。本法分则和其他法律另有规定的，依照规定。
