释义	法律分析： 1.在我国任何人没有非法剥夺他人的生命的权利。2.因此，除正当防卫和对死刑犯执行死刑的情形，在其他情况下杀人都是属于违法犯罪行为。对于故意杀人的，如果具有刑事责任能力，就应当承担刑事责任。法律依据：《中华人民共和国刑法》第二百三十二条故意杀人的，处死刑、无期徒刑或者十年以上有期徒刑；情节较轻的，处三年以上十年以下有期徒刑。第二百三十三条过失致人死亡的，处三年以上七年以下有期徒刑;情节较轻的，处三年以下有期徒刑。本法另有规定的，依照规定。
