释义	挂靠单位与没有单位的个人之间是不存在劳动关系的，这样的做法有伪造劳动关系嫌疑，并且在一定程度上危害了社保基金的安全。社保挂靠是指由于个人的原因（自由工作者，无单位等）导致公司没有为其缴纳社保，而自己又想购买社保，从而由代理机构（专门处理社保挂靠的公司）代理办理社保，并在其旗下公司购买社保的一种违法行为。按照我国相关规定社会保险有关规定，用工单位与劳动者建立劳动关系后应当为其缴纳社会保险。该内容由严达兴律师和法律部落共创回答
