释义	法律分析：婚姻关系因当事人一方死亡而终止，但婚姻关系并不只是建立了配偶关系，同时基于婚姻关系还产生了当事人与双方近亲属间的姻亲关系，而且婚姻关系的建立还改变了法定继承人的范围，配偶亦成为法定继承人。所以当婚姻关系的一方当事人死亡，但对婚姻关系仍有必要的确认其效力，利害关系人仍有权利向法院提出宣告婚姻无效。法律依据：《中华人民共和国民法典》第一千零五十一条有下列情形之一的，婚姻无效： (一)重婚; (二)有禁止结婚的亲属关系; (三)未到法定婚龄。
