释义	窃取国有档案罪的构成要件的客体为国家对档案的管理制度，客观方面表现为抢夺、窃取国家所有的档案的行为。主体为达到刑事责任年龄、具备刑事责任能力的自然人，主观方面表现为故意，即明知是国家所有的档案而进行抢夺或窃取。【法律依据】《中华人民共和国刑法》第三百二十九条第一款、第三款抢夺、窃取国家所有的档案的，处五年以下有期徒刑或者拘役。有前两款行为，同时又构成本法规定的其他犯罪的，依照处罚较重的规定定罪处罚。
