释义	离婚过错赔偿制度有三个限定：第一、提出损害赔偿的为无过错方，其他家庭成员不享有这个权利；第二、只有确实因对方过错导致离婚的才可以赔，未离成婚或不想离婚的不能提出或得到过错赔偿；第三、无过错方只能是向自己的配偶要求过错赔偿，从立法原意上应该是不允许向自己配偶以外的其他人提起此类诉讼的，所以承担损害赔偿责任的主体为无过错方的配偶，不能向婚姻关系以外的其他人提出，比如第三者或者"二奶"。
